This Privacy Policy explains how Fitly ("Fitly", "we", "us", or "our") collects, uses, shares, and protects your personal data when you visit our website, purchase our products, or use the Fitly scale and Fitly app. We are committed to protecting your privacy and handling your data in line with the EU General Data Protection Regulation (GDPR) and other applicable laws.

1. Who this policy applies to

This policy applies to:

  • Visitors and customers of our online store
  • Users of the Fitly scale (hardware)
  • Users of the Fitly app and Premium subscription

2. Information we collect

Information you provide to us

  • Order & contact details: name, email address, shipping and billing address, phone number.
  • Account details: the email and credentials you use to create a Fitly app account.
  • Payment information: processed by our payment providers — we do not store full card numbers ourselves.
  • Communications: messages you send us (support requests, emails).

Health & nutrition data (from the scale and app) Because Fitly helps you track nutrition and fitness, the app may process data that can relate to your health, including:

  • Food weights, calories, macronutrients and micronutrients you log
  • Photos of food you capture for AI photo tracking
  • Body weight, goals, and workout/activity data you enter
  • Usage history within the app

We treat this as sensitive data and only process it to provide the service to you.

Information collected automatically

  • Device and connection data (e.g., IP address, browser type, device identifiers, Bluetooth pairing data between the scale and your phone).
  • Usage data and analytics about how you interact with our website and app.
  • Cookies and similar technologies (see Section 7).

3. How we use your information

We use your data to:

  • Process and fulfil your orders and pre-orders, and ship your product.
  • Create and manage your Fitly account and Premium subscription.
  • Provide the core functionality of the scale and app (calculating and logging nutrition, syncing data).
  • Provide AI photo tracking and other app features.
  • Communicate with you about your order, account, and support requests.
  • Send marketing emails where you have consented (you can opt out at any time).
  • Improve our products, website, and app.
  • Detect and prevent fraud, and comply with legal obligations.

4. Legal bases for processing (GDPR)

We rely on the following legal bases:

  • Contract: to fulfil orders, provide the app/subscription, and deliver the service you signed up for.
  • Consent: for marketing emails, non-essential cookies, and processing of health/nutrition data in the app. You may withdraw consent at any time.
  • Legitimate interests: to secure and improve our services and prevent fraud.
  • Legal obligation: to meet tax, accounting, and other legal requirements.

5. How we share your information

We do not sell your personal data. We share it only with service providers who help us operate, including:

  • Shopify — our e-commerce platform (store, checkout, order management).
  • Payment processors — to process payments securely.
  • Apple / App Store — for app distribution and subscription billing where applicable.
  • Shipping carriers — to deliver your order.
  • Email and analytics providers — to send communications and understand usage.
  • AI/photo-processing providers — to power AI photo tracking, where used.

We may also disclose data if required by law, or to protect our rights, users, or the public.


6. International data transfers

Where data is transferred outside the European Economic Area (EEA), we use appropriate safeguards such as Standard Contractual Clauses or transfers to providers with an adequacy decision.


7. Cookies and tracking

We use cookies and similar technologies for essential site functionality, analytics, and (with your consent) marketing. You can manage your preferences via our cookie banner and your browser settings. Declining non-essential cookies will not affect core store functionality.


8. Data retention

We keep your data only as long as necessary:

  • Order records: as required by tax and accounting law.
  • Account and app data: while your account is active, and for a reasonable period afterward.
  • Marketing data: until you unsubscribe or withdraw consent. You can request deletion of your data as described below.

  • Rectify inaccurate or incomplete data.
  • Erase your data ("right to be forgotten").
  • Restrict or object to certain processing.
  • Data portability — receive your data in a portable format.

  • Lodge a complaint with your local data protection authority (in Estonia, the Andmekaitse Inspektsioon / Estonian Data Protection Inspectorate).

10. Data security

We use appropriate technical and organisational measures to protect your data, including encryption in transit and restricted access. No method of transmission or storage is completely secure, but we work to protect your information and to notify you and the authorities of breaches where required.


11. Children's privacy

The Fitly app is rated 9+ on the App Store and may be used by younger users under the supervision of a parent or guardian. Purchases from our store, however, must be made by an adult.

Where a user is below the age of digital consent in their country (13 in Estonia; up to 16 in some EU countries), a parent or guardian must review this policy, set up the account, and consent on the child's behalf to the processing of the child's data — including nutrition, weight, and activity data. Parents and guardians are responsible for supervising their child's use of Fitly. If you believe we have collected a child's data without appropriate consent, contact fitlysupport@gmail.com and we will delete it.


12. Changes to this policy

We may update this Privacy Policy from time to time. We will post the updated version here and update the "Last updated" date. Material changes may be communicated by email or in the app.
