Fitly — Terms of Service

These Terms of Service ("Terms") govern your use of the Fitly website, the purchase of Fitly products, and use of the Fitly scale and Fitly app. The service is operated by Lendoo OÜ (Juhkentali tn 8-5, 10132 Tallinn, Estonia) ("Fitly", "we", "us"). By using our website or products, you agree to these Terms.
1. Eligibility and age
To purchase from our store and enter into a contract with us, you must be at least 18 years old (or the age of majority in your jurisdiction) and able to enter into a binding contract.
The Fitly app is rated 9+ on the App Store and may be used by younger users under the supervision of a parent or guardian. Where a user is below the age of digital consent in their country, a parent or guardian must set up the account and consent to the processing of the minor's data (see our Privacy Policy). Parents and guardians are responsible for supervising a minor's use of Fitly.
2. Products and pre-orders
Fitly is sold on a pre-order basis and ships in approximately 6–8 weeks. By placing a pre-order you agree to the estimated timeframe. We reserve the right to limit quantities, correct pricing errors, or cancel orders in exceptional cases (with a full refund).
3. Pricing and payment
All prices are shown at checkout and may change over time. Applicable taxes and shipping are calculated at checkout. Payment is processed securely by our payment providers.
4. Fitly Premium subscription
The Fitly app's full functionality requires a Premium subscription. Where Premium is included with a hardware purchase, a redemption code may be provided to you by email. After any included period, Premium renews at the then-current price and is billed and managed through the Apple App Store, subject to Apple's terms. You can manage or cancel your subscription in your App Store account settings.
5. App licence and acceptable use
We grant you a personal, non-transferable, non-exclusive licence to use the Fitly app for your own personal, non-commercial use. You agree not to misuse the service, reverse engineer it, resell it, or use it in any unlawful way. Fitly is a nutrition and fitness tool and does not provide medical advice; consult a qualified professional for health decisions.
6. Accounts
You are responsible for keeping your account credentials secure and for activity under your account. Notify us of any unauthorised use.
7. Intellectual property
All content, branding, designs, software, and materials associated with Fitly are owned by Lendoo OÜ or its licensors and are protected by law. You may not copy or use them without permission.
8. Warranty and disclaimers
Products are provided with the statutory warranties required by law. Except as required by law, the website and app are provided "as is" without further warranties. We do not guarantee the accuracy of nutritional estimates, which are provided for informational purposes.
9. Limitation of liability
To the maximum extent permitted by law, Lendoo OÜ is not liable for indirect, incidental, or consequential damages arising from use of our products or services. Nothing in these Terms limits liability that cannot be limited by law, including your statutory consumer rights.
10. Returns and privacy
Returns and refunds are governed by our Return & Refund Policy. Your data is handled per our Privacy Policy. Both form part of these Terms.
11. Governing law
These Terms are governed by the laws of Estonia. Disputes are subject to the competent courts of Estonia, without prejudice to any mandatory consumer protection rights you have in your country of residence.
12. Changes
We may update these Terms from time to time. The updated version will be posted here with a new "Last updated" date. Continued use after changes constitutes acceptance.
